    Supreme Court Decision: Johnson v FirstRand Bank Ltd

    The Supreme Court has handed down its judgment this afternoon on the matter of Johnson v FirstRand Bank Ltd.

    The decision to overturn the Court of Appeal’s October 2024 ruling establishes that lenders are not liable for hidden commission payments in car finance schemes. Whilst Johnson’s claim was successful on the basis of the individual circumstances surrounding the case, the judgment dictated that claims against lenders based in equity and in tort cannot succeed.

    The Financial Conduct Authority has confirmed that it will release a decision as to whether a compensation scheme is to be implemented within weeks, although the Supreme Court’s decision indicates that most drivers’ claims will not go ahead.
