    Higgs v Farmor's School: Richard O'Dair Represents Claimant in Landmark Judgment

    The Court of Appeal has handed down judgment in the case of Higgs v Farmor's School, marking a win for claimant Kristie Higgs.

    The Barrister Group's Richard O'Dair, who appeared for Mrs Higgs in the Court of Appeal, said:

    "The Court of Appeal has said that if an employer wishes to interfere with freedom to express religious or other beliefs, any such interference must be objectively justified and must not infringe Article 9 or 10 of the ECHR. It rejected an argument that it is a defence if the employer genuinely believes that the employee has manifested her beliefs in an unacceptable way.

    It also held that it was clear that Mrs Higgs' dismissal was unjustified interference. In fact, she had posted criticism of pro-trans education polices and invited her readers to join in petition to Parliament. The Court reasoned that, taking account of a variety of factors, her dismissal was unreasonable."
